On July 14, 2017, the European Commission published the Regulation 2017/1269 of 13 July 2017 amending Implementing Regulation (EU) 2015/949 as regards withdrawal of groundnuts (peanuts) from the United States of America from the list of approved pre-export checks as regards aflatoxins.
 
The Article 23 of the EU regulation No 882/2004 on official food and feed controls allows the EU to officially recognize a third country’s system of pre-export checks (PEC) on feed and food prior to export as long as it meets the EU requirements. The pre-export checks program for peanuts was approved in December 2007. Under the Regulation, import authorities were directed to subject consignments of US peanuts with a PEC certificate (voluntary) issued by the US competent authority to a less than 1% control level at the border.
 
This new Regulation amends the Annex I to Implementing Regulation (EU) 2015/949 of 19 June 2015 approving the pre-export checks carried out on certain food by certain third countries as regards the presence of certain mycotoxins. Groundnuts (peanuts) from USA are deleted from the list, therefore consignments will be randomly controlled at the discretion of the import authorities.
 
The Regulation entered into force on July 17, 2017.
