The case is the second major challenge to Trump’s authority to issue tariffs

On June 20, 2025, the US Supreme Court declined to expedite review of a legal challenge to many of President Donald Trump’s tariffs, as reported by the New York Times. The legal challenge filed by two US companies alleges that Trump lacks the authority to authorize tariffs under the International Emergency Economic Powers Act (IEEPA). The companies had asked the court to fast-track their review of the case, arguing that the tariffs had caused a national emergency warranting swift judicial action. With the Supreme Court’s decision, however, the case will now be reviewed on the usual schedule and a ruling is expected later in the summer.

This case comes after a separate and broader challenge in which the US Court of International Trade also ruled against the administration’s tariffs program. The tariffs remain in place while that appeals process moves forward, with oral arguments scheduled for July 31.
