EU: Guidance Document on Packaging and Packaging Waste Regulation

On March 30, 2026, the European Commission published guidelines on the implementation of the Packaging and Packaging Waste Regulation (PPWR) to facilitate the uniform application of the new packaging rules across the EU.

Among other topics, the guidance document clarifies when a company is considered a manufacturer or a producer, as well as which items are considered packaging under the PPWR. It also spells out the restrictions on single-use packaging, enforcement of the restriction on per- and polyfluoroalkyl substances (PFAS) in food contact packaging, and the application of re-use targets. In addition, it provides guidance on how to apply extended producer responsibility for packaging and on the obligation to set up deposit and return systems.

The accompanying Frequently Asked Questions (FAQ) document addresses a wide range of practical issues raised by stakeholders since the adoption of the PPWR last year.

Spain: Food Waste Prevention Law Takes Effect

Spain passed a law on food waste prevention in April 2025, but businesses were given a one-year grace period to comply with the new rules. Mandatory compliance began on April 3, 2026.

Key provisions of the law include the following:

  • Food sector businesses must implement waste prevention plans.
  • Mandatory hierarchy for surplus food:
  1. Human consumption through donation to food banks or transformation
  2. Animal feed or industrial byproducts
  3. Composting, biogas or fuel production
  • Sector-specific requirements:
    • Restaurants must provide take-home containers at no extra cost
    • Retailers must promote discounted sales of near-expiry items
    • Producers must implement waste-reduction practices
  • Exemptions:
    • Businesses with fewer than 10 employees
    • Small farms
    • Establishments under 1,300 m²
