US court allows IEEPA tariffs to remain in place while Trump administration pursues appeal

On June 10, 2025, the European Commission concluded a public consultation on a list of US imports that could become subject to EU countermeasures if ongoing EU-US negotiations do not result in a mutually beneficial outcome and the removal of the US tariffs. The list of potentially affected products includes a broad range of nuts and dried fruits.

The INC submitted a position statement in opposition to additional duties on nuts and dried fruits from the US, arguing that tariffs would significantly hurt EU consumers and businesses by creating price burdens for households, harming the EU’s processing and manufacturing industry that relies heavily on nuts and dried fruits from the US as inputs in value-added products, threatening jobs, stifling innovation, undermining public health objectives, contradicting EU sustainability commitments, and incentivizing unethical trading practices.

After analyzing the results of the public consultation, the Commission will draft a formal proposal on countermeasures, which will go through the comitology procedure, allowing EU member states vote on it. The suspension of the US’s higher, country-specific tariffs (including a 20% tariff on the EU) is set to expire on July 8.

Finally, an update on the status of US tariffs imposed under the 1977 International Emergency Economic Powers Act (IEEPA). As noted in a previous INC update, a federal court ruled in late May that Trump did not have “unbounded authority” to impose tariffs under his novel interpretation of this statute. As expected, the Trump administration appealed the ruling. The U.S. Court of Appeals for the Federal Circuit ordered an administrative stay, allowing the tariffs imposed under IEEPA —specifically, the tariffs on goods from China, Mexico, and Canada, as well as the baseline 10% tariff on all imports from all origins— to remain in place during the appeals process. Oral arguments are scheduled for July 31.
